PRELIMINARY COVENANTS, CONDITIONS AND RESTRICTIONS


Main House Structure

  • Minimum 1300 square feet of air-conditioned living space exclusive of garage, porch, breezeway or other non-living area.
  • Minimum 8-foot exterior plate height above the foundation on the main floor.
  • Minimum roof pitch will be 6 in 12.
  • Minimum two-car attached garage.
  • All garages will be front or side entry.
  • Minimum 70 percent exterior in masonry product.
  • No metal or vinyl siding or similar materials or concrete block or similar materials will be allowed on the exterior of the home.
  • No manufactured housing (HUD-Code homes) will be allowed.
  • Only standard common house colors will be allowed on the exterior of the home and must be approved by the Architectural Control Committee.
  • All lots will have a concrete sidewalk along the entire length of the lot constructed by the home builder at the time the main house structure is built. Sidewalks must meet City of Howe Building Standards and will be set four feet back of the curb. On all corner lots, sidewalks shall be constructed along all adjacent streets.

Out Buildings of Any Nature

  • Out buildings will be limited to one per lot.
  • Exterior of any out buildings will be of the same material comprising the exterior of the main house and in the same percentages as that of the main house.
  • The roofing material must be the same as the main house.
  • No manufactured sheds or out buildings will be allowed.
  • No dog houses, play houses or clotheslines will be erected so as to be visible from any street, right-of-way or common area.

Fencing

  • No wire fences, to include woven wire, barbed wire, chain link or any other form of wire, will be allowed. No split rail fencing will be allowed. No fencing consisting of unfinished concrete blocks will be allowed.
  • All fence posts must be set a minimum of two feet in the ground and will be set in a concrete base with a minimum of six inches of concrete (3 inches on any side of the post).

Vehicles and Equipment

  • No inoperable vehicles or equipment, or vehicles or equipment parked on blocks or supported by other than the main running gear of that vehicle, will be parked so as to be visible from any roadway, pathway or driveway.
  • No more than four owned vehicles per dwelling, to include equipment of any nature, will be parked so as to be visible from any roadway, pathway or driveway on any one lot except during periods of construction of the main house structure or clearing of the lot.
  • Weight limit for any personal vehicle parked on any lot, driveway, street, right-of-way or common area will be one ton GVW.
  • Parking of any RVs, travel trailers or camping trailers overnight that are visible from any lot, roadway, pathway, common area or driveway is strictly forbidden.
  • No equipment or vehicles (other than automobiles) will be parked or secured overnight on any utility easement, common area, street or roadway.
  • Boat parking is allowed so long as the boat is parked or stored behind a solid, non-view fence. The boat must not be visible from any street, driveway, right-of-way or common area.

Signage

  • No commercial signage of any type is to be placed on the property so as to be visible from any street, right-of-way or common area, with the exception that one For Sale sign not to exceed two feet by two feet may be placed in the front yard while the home is being marketed. For Sale signs must be metal framed and placed so as not to be intrusive to neighboring housing units or pedestrian traffic, and must be removed within three working days of the house being sold or removed from the market.

Miscellaneous

  • No trash or trash receptacles will be placed so as to be visible from any street, right-of-way or common area other than on the day of scheduled trash pick-up.
  • All residents and/or guests will immediately remove trash or debris that may be visible to the public.
  • During construction of any nature, all debris, excess construction materials or trash will be stored in trash containers or construction containers so as to maintain a clean and orderly appearance during periods of construction. Under no circumstances will trash or debris be stored or left loose so that it blows or moves to an adjacent lot, street, right-of-way or common area.
  • Lighting, such as flood, security or illumination lighting, will be aimed so as to not illuminate neighboring properties or residences.
  • All mailbox designs and locations must be of a common type pre-approved by the Architectural Control Committee.
  • All home construction shall first be subject to approval by the Architectural Control Committee.
